Signature of this document or interviewing a candidate introduced by iJob iJob will constitute acceptance of the
terms and conditions contained herein.
The placement fee ("the fee") payable to iJob iJob for the introduction of the candidate to the employer shall be
earned upon the candidate's employment. The employer shall notify iJob iJob immediately of the candidate's
engagement.
The fee payable to iJob iJob shall comprise 15% of the aggregate annual salary, value of car allowance or company
car and other benefits due to the candidate in terms of his/her contract of employment (collectively the "cost to
company" remuneration) with the employer plus guaranteed bonus(es), verbal bonus(es), joining fees, plus VAT. In the
event of temporary employment the fee will be payable monthly based on 10% of the monthly CTC.
Payment is due within 10 days of presentation of invoice. Interest will be charged at 2% per month on overdue accounts.
The employer will be liable to iJob iJob for the full fee referred to in clause 3 hereof if the candidate is employed
as a result of the introduction irrespective of whether such introduction is direct or indirect and irrespective of when the
candidate commences employment with the employer, provided that the offer of employment is made within one year
of the introduction. If at any time within the above one year period, there are employment negotiations between the
employer and the candidate, the one year period shall recommence from the date of such negotiations. If a candidate is
employed by any other party following an introduction or referral by the employer, then the employer shall remain liable
to iJob iJob for the full fee referred to in clause 3 hereof, as if the employer had employed the candidate.
In the case of permanent employment iJob iJob shall guarantee a candidate for a period of 3 (three) months from
commencement of employment provided that the full fee due to iJob iJob in terms hereof reaches our offices
within 10 (ten) days of the employment of the candidate and iJob iJob has received written notification of the
actual termination of the candidate's employment within 10 (ten) days of the date thereof. In the above circumstances
the employer will be entitled to a refund of the placement fee to the following extent: 75%, 50%, or 25% should the
candidate leave during the first, second or third month of employment respectively.
In the event of a contracted employee taking up a permanent position at the company, the terms and conditions for
permanent employment contained herein will be applied.
iJob iJob’s full fee remains payable where the employer withdraws an offer made to iJob iJob’s candidate
for reasons internal to the employer and not due to any fault of the candidate.
Notwithstanding that the applicant introduced to the employer in terms hereof has been screened and that reference
checks, where feasible, have been performed, iJob iJob shall not be liable for any loss, damage or injury to person
or property from whatsoever cause arising directly or indirectly from any act or omission of a candidate introduced by
iJob iJob.
The conditions contained herein constitute the entire contract between iJob iJob and the employer and no
variation shall be valid and binding upon the parties unless put in writing and signed by the parties to the contract.
No concession, indulgence or extension of time which may be allowed by iJob iJob to the employer shall under
any circumstances be deemed to be a waiver of iJob iJob’s rights in terms of this contract.
The employer shall be liable for all reasonable legal costs as between attorney and client, including collection charges,
incurred by iJob iJob in the recovery of fees and/or any other amount owing by the employer.
If the employment of a candidate engaged through iJob iJob is terminated due to an act over which iJob iJob
had no control and not due to the fault of the candidate or if the candidate leaves within 3 months of employment due
to material change of terms of employment, change in management or job description or due to any breach by the
employer of current labour legislation, the full fee referred to in clause 3 shall be payable.
The employer agrees that all information concerning the candidate as furnished by iJob iJob shall be treated in the
strictest confidence and on condition that it is not divulged by the employer to anyone without iJob iJob’s written
consent; and no contact whatsoever shall be made by the employer with the candidate's existing employer without the
candidate's written consent.
Neither iJob iJob nor its members, staff or representatives may be held liable to or for employers or companies
who do not abide by legislation contained in or governed by the Labour Relations Amendment Act of 2002, the BCEA
Amendment Act of 2002 or the Employment Equity Act of 1998.
